1. General Information

These terms and conditions govern the sale of services and experiences between the Endemicxperiences Unipessoal LDA and the client.

The Endemicxperiences Unipessoal LDA through its promotional means, presents and offers a number of tourist entertainment activities to be enjoyed by the buyer directly or indirectly. These activities are organized, performed and produced by Endemicxperiences Unipessoal LDA.

Once the activity has been selected, the Endemicxperiences Unipessoal LDA will send you, after payment of the respective price, a receipt by email that will grant you the right to perform the activity purchased.

2. Registration, booking and reserve

2.1 Registration for an activity presupposes knowledge and acceptance of these conditions.

2.2 The particular conditions overlap with these general conditions.

Activities must be scheduled as far in advance as possible. You should only consider the booking as definitive after receiving confirmation of our services by email.

3. Activities

3.1 The details and the respective levels of difficulty of the activities are available for consultation on the Endemicxperiences Unipessoal LDA Website, and they can be transmitted verbally or sent when requesting information or hiring them.

3.2 Since the activities are heavily dependent on weather conditions, it is possible that your activity has to be changed. The information provided by Endemicxperiences Unipessoal LDA regarding the duration and type of activity is always based on estimated and under ideal circumstances, so no rights are due for changing the activities or their routes.

3.3 The Endemicxperiences Unipessoal LDA reserves the right to cancel activities, with no compensation. In this case, the Endemicxperiences Unipessoal LDA will reimburse the customer for the amount already paid when:

a) the participants required for each activity are not present (when applicable);

b) weather, hydrographic, security or other conditions make it impracticable.

3.4 Confirmation of the activity is carried out after receipt of proof of payment for the activity. Due to unstable weather, Endemicxperiences Unipessoal LDA has the right to confirm the activity up to 12 hours before it.

3.5 The right to carry out an activity with the corresponding proof of payment/voucher ceases when:

a) the client does not show up at the place and time mentioned on the booking form or transmitted to perform the activity;

b) the customer, before starting the activity, does not present a proof of payment/valid voucher;

c) according to the administration of Endemicxperiences Unipessoal LDA, payment for the respective activity has not been received and the client cannot, at that moment, present a proof of payment. In all these situations, it is considered that the activity was performed. The proof of payment/voucher loses its validity. This also applies to situations where it is not possible to perform the activity due to the circumstances described in the art. 3.3 º .

3.6 The participants in activities must comply with the instructions given by the Endemicxperiences Unipessoal LDA guides before, during and after the activities.

3.7 When participating in an activity, customers accept the risks arising from them, and Endemicxperiences Unipessoal LDA cannot be held responsible for them.

3.8 Endemicxperiences Unipessoal LDA is not responsible for any damage or loss of personal objects (items of clothing, cameras,camcorders, etc.).

3.9 Endemicxperiences Unipessoal LDA is not responsible for any damage/injuries caused to customers by the use of personal objects(earrings, piercings, camcorders, cell phones, etc.).

3.10 Endemicxperiences Unipessoal LDA cannot be held responsible for any damages/injuries arising from pre-existing illnesses/injuries at the time of the activity.

3.11 Endemicxperiences Unipessoal LDA cannot be held responsible for accidents resulting from participants' carelessness or their disregard for their guides' instructions.

3.12 Endemicxperiences Unipessoal LDA cannot be held responsible for acts that do not depend on its will or control or that of its employees.

4. Restrictions

4.1 It is the customer's responsibility to ensure it is in conditions of health (physical and mental health, etc,.) to perform the contracted activities.

4.2 It is the customer's responsibility to indicate whether they suffer from the following diseases: cardiovascular, respiratory, neurological, orthopedic, glaucoma, chronic otitis, sinusitis, epilepsy, drug addiction, alcoholism, diabetes or others.

In case of doubt, please contact us. We guarantee that we will do everything possible to make our customers with some kind of physical limitation always have the opportunity to enjoy our activities properly. To this end, we request that any such restrictions are mentioned before the time of purchase/reservation, so we can take the necessary steps to meet the needs of our client.

Note: General restrictions (conditions applied by the technical specifications of the equipment):

  • Minimum age allowed: under 18 only with parental/guardian authorization;

  • Maximum age admitted: 74 years old;

  • Minimum height and weight: 25 kg | 120cm;

  • Maximum weight and height: 120kg | 210 cm.

5. Refunds

We refund all undated vouchers up to 15 days after the date of purchase. The refund is always made to the entity or person who purchased the voucher, unless expressly stated otherwise. In cases of payment by credit card, the refund amount will be credited to that card account.

6. Cancellations

If you wish to cancel or change your appointment, you must do so with a minimum of 1 working day. Cancellations with less than the period mentioned above will result in the loss of the right to a new appointment. If you do not show up on the scheduled date and place to carry out your activity without canceling your appointment under the aforementioned terms, you will lose the right to enjoy it.

Important: You can only cancel your activity once (within the rules above). A second cancellation will lead to the loss of the right to enjoy the same. In case of need to cancel the activity for reasons beyond our control (for example: weather conditions, etc.), we will notify you as soon as possible and will make every effort to present you with an alternative date of the activity at your convenience.

6.1 On the day: if you have any problems on the day of the activity or any complaints to make, please mention it directly to Endemicxperiences Unipessoal LDA management via email endemicxperiences@gmail.com at the first opportunity, so that we can reward you and improve our service.

7. Atmospheric conditions and technical unforeseen

The activities are subject to favorable technical and atmospheric conditions. If the activities are canceled, you will be offered the possibility of making a new reservation, with the customer having to indicate a new date, but always subject to the weather conditions of the respective day and availability of the Endemicxperiences Unipessoal LDA. If the customer incurs expenses or losses resulting from a cancellation on the same day due to adverse weather conditions or unforeseen circumstances beyond the control of Endemicxperiences Unipessoal LDA, the latter cannot be held responsible for them.

8. Insurance

The risks inherent in performing activities of tourist activities are covered by a personal accident policy and a liability policy whose coverage is provided for in the legislation, namely:

i) Payment of treatment expenses, including hospital stays, and medicines, up to an annual amount of €3500;

ii) Payment of a capital of €20,000, in the event of death or permanent disability of its clients, reducing the capital upon death to the reimbursement of funeral expenses, when they are under 14 years of age;

iii) Civil liability insurance guarantees €50,000 per claim, with the annuity covering damage caused by claims occurring during the term of the policy, as long as they are claimed within one year of the termination of the contract.

Liability insurance ensures € 50,000 per claim, with the annuity to guarantee damages caused by accidents occurring during the policy period, provided that it is unclaimed for one year after termination of the contract.

Note: Any and all expenses above these amounts cannot be charged to Endemicxperiences Unipessoal LDA. If you wish to insure the activity with values higher than those contracted and/or not included in the contracted policy, Zona Canyoning may request a specific proposal from the insurance company.

9. Vouchers

9.1 Vouchers: once the activity has been selected, Endemicxperiences Unipessoal LDA will send you, after payment of the respective price, a voucher that will grant you the right to carry out the purchased activity, which you will have to present on the day(s) of the activity. ) activities).

9.1.1 Voucher delivery: your voucher is sent by email. Shipping is made after the payment method has been successfully charged. The voucher can be sent to you or directly to whoever you indicate as long as you clearly identify the data relating to the recipient. If your voucher, for any reason, does not reach the recipient, we will send a new voucher at no additional cost, canceling the lost voucher.

9.2 Validity of vouchers: all vouchers have a validity period of 1 year after the date of purchase, unless otherwise stated on the voucher. During the 6 months following the end of the validity period, vouchers can be revalidated once upon payment of a fee of €25. After this period, the voucher is canceled and cannot be revalidated. The revalidation of the voucher does not give it a new validity period, only allowing a new appointment as long as it is made within the next 5 working days, for a date within 3 months immediately following the revalidation.

9.3 Description of vouchers: the description of each voucher on our website is abbreviated but as explicit as possible. However, the content and format of vouchers may vary throughout the year. Updated details are available through our website www.endemicxperiences.com. These details may also be mentioned on the voucher sent to you and when confirming your reservation.

9.4 Exchange of vouchers: exchange of vouchers is permitted, as long as they are available in the Endemicxperiences Unipessoal LDA voucher catalog with the deduction of a service fee.

10. Image rights

During its activities, Endemicxperiences Unipessoal LDA provides image and video coverage (with sound) of the aforementioned activities. Therefore, unless otherwise indicated in writing, prior to carrying out the activity, the participant in the activities assigns all rights and authorizes the use of photos and videos collected during the activities and in the periods before and after them, for placement on the website and sending the audiovisual material to all customers and in marketing and advertising actions by Endemicxperiences Unipessoal LDA or its partners. All copyrights are also reserved to Endemicxperiences Unipessoal LDA.

11. Privacy

Endemicxperiences Unipessoal LDA guarantees, by all possible means, the confidentiality of all data provided by its customers. Holders of the data collected have the following rights:

1) Right to information (article 10 of the LPD), that is, at the time of collection you must be informed regarding the purpose of the collection;

2) Right of access, rectification and deletion (art. 11 of the LPD);

3) Right to object (art. 12 of the LPD) to the use of data for marketing or communication purposes to third parties.
